South Dakota requires any person who has been convicted of a sex crime or has received a suspended imposition of a sentence for a sex crime to register with the state registry. A juvenile that is 15 or older and is adjudicated of rape, promotion of minor prostitution or a felony sexual contact is required to register.

A sex offense or sex crime in the state of South Dakota is defined as any of the following:

• Rape

• Sexual contact with a minor under 16, if committed by an adult and the adult is charged with a felony.

• Sexual contact with a person incapable of consenting, if committed by an adult

• Adult committing incest

• Possessing, manufacturing and distributing child pornography

• Sexual exploitation of a minor

• Kidnapping if the victim is a minor

• Promotion of prostitution of a minor

• Criminal pedophilia

• Indecent exposure

• Solicitation of a minor

• Attempt to commit an offense listed above

Registrants are required to provide the following information:

• Name and aliases

• Address

• Type of sex crime

• Date of commission and conviction for any sex crime committed
