Any individual, regardless of age, who lives in South Carolina or another state and has been convicted of, plead guilty or nolo contendere to a sex crime is required to register. A juvenile who has been adjudicated delinquent for a sex offense may also be required to register.

A sex offense is defined as:

• Criminal sexual conduct in the first, second or third degree
• Criminal sexual conduct with minors in the first or second degree
• Engaging a minor for sexual performance
• Promoting sexual performance by a minor
• Assault with the intent to commit criminal sexual conduct
• Buggery
• Incest
• Committing or attempting a lewd act upon a minor under 16
• Peeping, voyeurism or aggravated voyeurism
• Obscenity involving a minor
• Material harmful to a minor
• Child exploitation
• Child prostitution
• Indecent exposure
• Kidnapping
• Criminal sexual conduct when the victim is a spouse
• Sexual battery of a spouse
• Sexual intercourse with a patient or trainee

The South Carolina State Law Enforcement Division requires the following information to be gathered:

• Race
• Date of birth
• Age
• Height and weight
• Hair, eye and skin color
• Last reported address
• offenses
• Scars, marks and tattoos
• Whether or not they are a predator
