Sexual or violent offenders are required to register by Montana State Law.  A "sexual or violent offender" is someone who has been convicted of a sexual or violent offense.

Under Montana law, a sexual offense is the violation of, attempt, solicitation or conspiracy to commit:

• Unlawful restraint, if the victim is under 18 and the offender is not the victim's parent.
• Kidnapping and aggravated kidnapping
• Sexual assault if:
  • The victim is under 16 or the offender is three or more years older
  • The offender inflicts injury upon anyone in the course of committing the sexual assault
  • Sexual intercourse without consent
  • Indecent exposure, if the victim is under 18 and the offender is over 18.
  • A third or subsequent conviction for indecent exposure, no matter the victim's age.
  • Incest if the victim is under 18 or if the offender is three or more years older
  • Promoting prostitution of a minor under 18, regardless of whether or not the offender knows the victims age.
  • Sexual abuse of a minor
• Violation of another state's laws or the federal government's laws.

A violent offense is one of the following:

• Deliberate or mitigating-deliberate homicide
• Aggravated assault
• Third or subsequent offense of partner or family member assault
• Assault on a peace officer or judicial officer if the offender purposely or knowing causes:
  • Reasonable apprehension of serious bodily injury to a peace or judicial officer by using a weapon.
  • Serious bodily injury to a peace or judicial officer
• Assault on a minor.
• Assault with a weapon
• Robbery
• Arson
• Violation of another state's law or the federal government's laws.
