Idaho Sex Offender Registries
The Idaho Sex Offender registration in Idaho was begun on July 1, 1993.  The registry has also established a statutory duty for individuals who have been convicted of specific felony sex crimes to register with the local sheriff.  In 1998, the Legislature repealed this original act and established the "Sexual Offenders Registration Notification and Community Right-to-Know Act" that was designed to strengthen and expand public access to this information.  The "Juvenile Sexual Offender Registration Notification and Community Right-to-Know Act" was also created under new legislation in 1998.  Previously, only juveniles that were convicted as adults were required to register.

Any person who has been convicted of a sexual offense, or an attempt or conspiracy to commit a sexual offense on or after July 1, 1993 must register.  Individuals who are a non-resident, regularly employed or working in Idaho or is a student who was convicted and found guilty of a sex offense is also required to register his or her state of residence in Idaho.  Juveniles who were between the age of 14 and 18 at the time of the sexual offense was committed on or or after July 1, 1998 are required to register.  Individuals have 10 days of coming into any county to live in Idaho or temporarily live must register at the local sheriff's office in that county.

Idaho sex offenses include:

  • Assault with an attempt to commit rape, an infamous crime against nature or lewd and lascivious conduct with a minor.
  • Battery with an attempt to commit rape, an infamous crime against nature or lewd and lascivious conduct with a minor.
  • Sexual abuse of a minor under 16.
  • Ritualized abuse of a minor.
  • Sexual exploitation of a minor.
  • Possession of sexually exploitive material other than for a commercial purpose.
  • Lewd conduct with a minor.
  • Sexual battery of a minor 16 or 17 years of age.
  • Murder committed in perpetration of rape.
  • Indecent exposure, excluding misdemeanor convictions.
  • First degree kidnapping committed for the purpose of rape, infamous crime against nature, lewd and lascivious acts upon any minor under 16 or for purposes of sexual gratification or arousal.
  • Second degree kidnapping of a victim that is not related to the offender.
  • Rape
  • Incest
  • Crimes against nature
  • Forcible sexual penetration by use of a foreign object.

Information that is gathered for the initial registration includes:

  • Name and aliases
  • Social Security Number
  • Physical description and Identifying Features
  • Current physical address or physical description of current residence
  • Offense for which he or she was convicted
  • Sentence received for offense
  • Conditions of release
  • Treatment or counseling received
  • Risk assessment or special category.
